(ANITA) HER ATTORNEY ALSO FILED A COMPLAINT WITH THE DEPARTMENT OF EDUCATION — AND 10 ON YOUR SIDE’S LIZ KILMER IS ON THE STORY TONIGHT. LIZ, THOSE FINDINGS ARE IN? TOM ANITA — THAT’S RIGHT ACCORDING TO SURVJUSTICE, THE NOT-FOR-PROFIT REPRESENTING THE WOMAN WHO CLAIMS SHE WAS VIOLENTLY RAPED IN HER DORM ROOM. THE GROUP SAYS THE DEPARTMENT OF EDUCATION SENT THEM THIS DOCUMENT STATING THE CASE WAS REVIEWED — AND THAT QUOTE “SERIOUS SHORTCOMINGS IN ODU CAMPUS SAFEY OPERATIONS” WERE IDENTIFIED. FROM FAILING TO PROVIDE PROTECTIVE MEASURES — TO RETALIATION. THE ACCUSATIONS MADE AGAINST O-D-U’S HANDLING OF A REPORTED ON-CAMPUS RAPE — ARE LONG. … THEY’RE CLAIMS–REVIEWED BY THE DEPARTMENT OF EDUCATION– WHICH STATES IN THIS DOCUMENT — THAT “SERIOUS SHORTCOMINGS” WERE FOUND– ACCUSING THE SCHOOL OF FAILING TO COMPLY WITH A LAW THAT REQUIRES CAMPUS’ TO REPORT CERTAIN CRIME STATS AND POLICIES. SHELTER MOBILE CRISIS COORDINATOR “ALMOST ALL THE CAMPUSES AROUND THE COUNTRY ARE HAVING SHORTFALLS WHEN IT COMES TO SEXUAL ASSAULT” IN THE O-D-U CASE — ALSO PLAYING OUT IN FEDERAL COURT — ATTORNEYS WITH SURVJUSTICE CLAIM THE VICTIM WAS VIOLATED NOT JUST BY THE ALLEGED ATTACK BUT BY THE CAMPUS’ RESPONSE. IT CLAIMS AN 8 HOUR INTERROGATION WITH ODU POLICE FOLLOWED HER REPORT — AND DELAYED A MEDICAL EXAM. FOLLOWING THE DEPARTMENT OF EDUCATION FINDINGS NOTED THIS WEEK– AN O-D-U SPOKESPERSON RELEASED THIS STATEMENT, READING, IN PART: “BECAUSE THIS MATTER IS PENDING WITH THE U.S. DEPARTMENT OF EDUCATION (DOE) AND OLD DOMINION HAS NOT BEEN CONTACTED BY DOE AT ANY POINT TO DATE REGARDING THIS MATTER, WE ARE UNABLE TO COMMENT PUBLICLY.” IT GOES ON TO STATE THE SCHOOL IS CONTINUALLY ENHANCING SAFEGUARDS. NIKKI DUNCAN-TALLEY, WITH THE HELP AND EMERGENCY RESPONSE SHELTER — SAYS, THAT’S TRUE. DUNCAN-TALLEY “THE STRIVE TOWARDS ENDING THE VIOLENCE IS ACTUALLY… O-D-U’S KIND OF ON THE FOREFRONT OF THAT.” SHE SAYS O-D-U IS IMPLEMENTING EMERGING PROGRAMS TO COMBAT SEXUAL ASSAULT, LIKE GREENDOT– WHICH TEACHES WAYS TO PREVENT A DANGEROUS SITUATION FROM PLAYING OUT. THIS INCOMING FRESHMAN SAYS SHE’S ALREADY BEEN INTRODUCED TO PROACTIVE PROGRAMS AND CLASSES. US AND THEY TOLD US ABOUT A NEW APP THAT IN GENERAL CAN REPORT CRIMES SO I FEEL LIKE THEY HANDLE IT WELL.” WE ARE STILL WORKING TO GET INFORMATION FROM THE DEPARTMENT OF EDUCATION — TO HAVE THEM SPECIFY MORE ABOUT THESE APPARENT “SHORTCOMINGS.” NO ONE WAS EVER CRIMINALLY CHARGED IN THIS CASE.
